Types of ADR
FACILITATION
- A trained Administrative Law Judge (ALJ) may conduct workshops and use process techniques and skills to ensure that all viewpoints are heard and progress is made.
MEDIATION
- With parties' consent, a case is referred to a trained ALJ mediator who holds joint and/or separate confidential meetings with parties to identify underlying interests and use settlement approaches to help parties resolve a dispute.
EARLY NEUTRAL EVALUATION (ENE)
- With their consent, parties present abbreviated versions of their case to one or more trained ALJ neutrals who provide early, nonbinding opinions on the merits of the controversy.
- ALJ holds intensive conferences with parties to help them negotiate by narrowing issues and exploring settlement options.
A trained ALJ neutral uses facilitation, mediation, and/or early neutral evaluation techniques to help parties resolve their dispute(s).
